So, I laid out, briefly, my case against him in the pre Action protocol that will commence Proceedings.

I got an Immediate offer, within an hour, of just under 50% - that the Boss wants to take. “ Full & Final “ etc etc. My arse.

I dont. I think that just rewards Deception- albeit by only a few hundred, but it’ll surely encourage him to go again?

Having researched him at some length, I now think could be construed as a Deliberate Fraud. He’s done it at least 8 times- getting away with most. There is a valid 8k CCJ against him, unsatisfied, and there have clearly been others, enforced by the High Court. However, I believe I can’t bring these up in Proceedings- although I sure as hell will include some of the Reviews.

So, do I hang on, fight for the full amount (then take my file to the Old Bill) - or do I roll over and take the small loss?

So, should I go for every penny or might the Judge think I’m wasting Court time?m

Playing Devil's Advocate I have to say I am with the Boss. Half a bird in the hand is better than the moral victory of a whole one that might well fly the coop....By the time judgment is made it might transpire that he has "no" money.
There's a great long bar in Rock & Roll heaven.......

He runs a Taycan (on a private plate) & aZZR1400 bike. I don’t think he’s skint- but I see your position. Torn right now

He may well have a taycan and a superbike but are they paid for or on tick? I'd say the latter. So in that case they will be repossessed by the lender and he will file for bankruptcy and the losers in all the situations will be the porr folk out of pocket. He will fuck off and set up another business in another name under his wife or kids name. Rinse and repeat and infinitum. I'd be tempted in that case to ask for 75%. Maybe Warren can shed more light on the bankruptcy,ccj and debtors situation?

I'm with Drum. If that fails though I'd go the Merc route especially as there's a valid 8k judgement against him.

Also the Taycan could be leased and the private plate bought for peanuts years ago.

About 20 years ago we were ripped off by a builder who we thought was a friend.
We minimised our loss but never went 'legal' as we thought it'd just enrich the legal profession and we'd have a load of strife. I would like to have seen him crucified but common sense, i.e, my missus, prevailed.

Try a higher offer, take what you can & then go to the Old Bill anyway. Not that they'll do anything, it's too much like work for them.
